Adjustment of the terms of a contract worth more than 100 million rubles is possible only based on the results of a re-examination

This statement was made by Sergey Lakhaev, Deputy Head of the Glavgosexpertiza of Russia on pricing, who moderated the round table "Pricing in construction", which was held in Yekaterinburg by the Ministry of Construction of Russia and Glavgosexpertiza of Russia as part of the 100+ forum TechnoBuild.
The discussion was opened by Sergey Muzychenko, Deputy Minister of Construction, Housing and Communal Services of the Russian Federation, who spoke about the main areas of work of the Russian Ministry of Construction in regulating pricing in construction. According to the Deputy Minister, one of the key tasks at present – implementation of Decree of the Government of the Russian Federation No. 1315 dated August 9, 2021, establishing rules for changing the terms of the contract in connection with a significant increase in prices for construction resources in 2021. 100 billion rubles will be allocated to compensate for the increased costs of developers who signed contracts for state orders before July 1, 2021.
In addition, the resolution recommended to the highest executive bodies of state power constituent entities of the Russian Federation, local administrations, as well as legal entities making purchases in accordance with Federal Law No. 44-FZ "On the Procurement of Goods, Works, Services by Certain Types of Legal Entities" when increasing the price of the contract, take into account the provisions of Decree of the Government of the Russian Federation No. 1315. « To date, more than 60 subjects have already adopted regional acts in the development of the Federal Law No. 44-FZ "On the Procurement of Goods, Works, Services by Certain Types of Legal Entities", Sergey Muzychenko said.
Deputy Head of the Glavgosexpertiza of Russia Sergey Lakhaev added that over 37,700 people have already visited a special information portal in the FSIS CA, which contains information on the procedure and conditions for recalculating the contract price based on Government Decree No. 1315. In addition, the portal regularly updates the feed of questions and answers. "Now there are already about 140 answers of specialists from the Glavgosexpertiza of Russia to standard questions," said the deputy head of the department.
He also announced the continuation of the joint work of the Ministry of Construction of Russia and the Glavgosexpertiza of Russia on amendments to Government Decree No. 1315 and Methodology No. funding. Sergey Lakhaev also reminded the round table participants that the terms of a contract worth more than 100 million rubles can only be adjusted based on the results of a repeated state examination of project documentation.
