The Hague District Court has decided to lift the seizure of Gazprom&s assets in the Netherlands. Among the released assets are shares in projects such as Wintershall Noordzee and Gazprom International Projects. This decision was the result of the seizure of assets, which was carried out in the fall of 2024 on the claims of the Ukrainian companies Slavutich-invest and Zhniva.
Ukrainian companies insisted on compensation for the lost assets that were damaged during the military operations on the territory of Ukraine. Thus, Slavutich-invest owned eight plots of land in Melitopol, while the Reaper company from Odessa leased 18 elevators in the Zaporizhia and Kherson regions. The companies stated the need for compensation, sending claims to both Russia and Gazprom as its representative.
It is worth noting that earlier the Ukrainian court recognized Gazprom, Gazprom Capital and Gazprom International as the "second self" (alter ego) Of the Russian Federation, which served as the basis for debt collection from these companies. However, the court in The Hague concluded that the assets of Gazprom International are subject to the principle of state immunity. In his opinion, this company is considered as an integral part of Russia in the context of Ukrainian legislation. The application of the principle of State immunity implies that a State-owned enterprise cannot be prosecuted in a foreign court without the consent of its State. In this regard, the Hague court cancelled the arrest, considering it a violation of this principle.
Gazprom controls 50% of the Wintershall Noordzee joint venture, which has been producing gas on the Dutch continental shelf since 1965 and operates 11 offshore installations in the North Sea.
